Course Description
Estate planning and elder law attorneys may unexpectedly become the first point of contact when a client’s loved one suffers nursing home neglect or abuse. While you may not litigate personal injury cases, you play a critical role in identifying viable claims, guiding families, and partnering with specialized nursing home injury lawyers. This CLE presentation offers a practical roadmap with four key sections: • Vetting Nursing Home Cases – How to tell a legal case from a non-legal complaint, and direct families appropriately. • Referring & Partnering with Injury Counsel – How to find the right lawyer, set up ethical co-counsel or referral arrangements, and understand your role (and fee) with minimal extra work. • How Nursing Home Injury Cases Work – A walkthrough of typical litigation stages, types of claims (negligence, wrongful death, resident rights), and ways an estate lawyer can support the client through the process. • Settlement Processing – How wrongful death settlements are approved in probate court, and how to handle Medicaid and other issues so the family’s recovery is maximized and compliant with state requirements.
